The Administrative Court of Sport (TAD) has decided not to disqualify Javier Tebas, but has determined a public reprimand for the president of LaLiga. Following a complaint from Real Madrid that the Higher Sports Council submitted to the TAD, the sports court opened a file for very serious misconduct against the top leader of the employers’ association for not having called ten days in advance the August 2021 meeting in which the agreement with CVC was voted on, by which the professional clubs received an injection of 1,942 million euros from the fund in exchange for an annual percentage, of up to 8.6%, of the audiovisual income generated by the competition. 38 of the 42 professional teams that then formed part of the First and Second Divisions joined the plan.
The League itself had already rectified in the same month of December 2021, calling again the assembly of clubs in which the agreement was approved again. For this reason, the TAD has reduced the sanction to Tebas to a mere public reprimand. In addition, the regulations punish the reiteration of the failure to call the assemblies and not a mere delay. For this reason, Tebas reproached Rodríguez Uribes, president of the Higher Sports Council (CSD), for raising the complaint to the TAD at the request of Florentino Pérez.
Although Tebas has not been disqualified, LaLiga plans to appeal the public reprimand, considering that the meeting was called urgently by the employers’ delegated committee on August 4, 2021 and that it was not necessary to specify the reasons why it was urgent, as stated in the statutes. “It is not the first time that LaLiga has called a general meeting in this way; it has been called in the history of the entity in the same circumstances under the mandate of different presidents and without any opposition from Real Madrid CF until that date. It is, therefore, a consolidated action, which had never been questioned by the clubs. Therefore, from the point of view of LaLiga, there is no infringement in the conduct of president Javier Tebas Medrano. In addition, the call for the General Assembly complied with all the statutory requirements,” LaLiga clarifies in a note.
