The chief magistrate of the Commercial Court No. 17 of Madrid has partially upheld this Monday the lawsuit filed by the European Super League Company SL (ESLC) against UEFA and FIFA and has declared that both organizations have abused their position of dominance and They are preventing free competition in the market by granting themselves the discretion to prohibit participation in alternative competitions and impose “unjustified and disproportionate” restrictions that infringe articles 101 and 102 of the Treaty on the Functioning of the European Union (TFEU). This resolution can still be appealed before the Provincial Court of Madrid.

The ruling also orders FIFA and UEFA to cease the sanctioned anti-competitive conduct, in addition to condemning them to immediately remove all the effects of the anti-competitive actions that have occurred before or during the duration of the procedure, which began in April 2021, when ESLC announced the launch of a new professional football competition project, the Super League.
